BIG TRIVIA COMPETITION: RULES AND REGULATIONS

 This is a skilled trivia knowledge-based competition with prizes to be awarded based upon the highest score obtained by participants who have correctly answered trivia knowledge-based questions.  By participating in the competition you are agreeing to these Rules and Regulations

 TO PARTICIPATE:

If your cellular/mobile phone comes with the capability to play the Big Trivia Competition, visit Cosmic Games located on the menus of your cellular/mobile service provider’s wireless website or download Big Trivia to your wireless device. You must access the game via official Cosmic distribution channels. The rules of play for each competition can be found in the Help section of each game on the cellular/mobile phone used to play.  Players are responsible for their regular service fees associated with using the wireless web service of their cellular/mobile service provider to participate in the competition.

 Play Cosmic's Big Trivia game. To score points, you must successfully win a game of Big Trivia.  Each time you win a game, you will receive one point for each player you beat in that game. The time period and/or number of games for any particular Big Trivia Competition will be established by Cosmic Infinity Inc. and set out when you log onto the game lobby (each a “Competition Period”).

 WINNER SELECTION & NOTIFICATION:

The eligible player with the most verified competition points at the end of each Competition Period will be the winner.   In the event of a tie at the end of a Competition Period, the player who was to first to reach those points shall be the winner of that competition.  The winner of each competition will be notified by a message when next logged onto the Big Trivia Competition on their cellular/mobile device with instructions as to how to claim the prize.  The winner of each competition may be required to provide an acknowledgement of these terms and release and/or parent/guardian acknowledgement and release to claim the prize.

 PRIZES:

Prizes are offered for skilful participation in each competition and methodology is used to ensure prizes are awarded based upon skill and not chance.  The prize and approximate retail value will be posted in the opening or welcome information for each competition.  Winners must claim their prize in the manner instructed in their winning notification within 30 days following the end of the Competition Period failing which the prize shall be forfeited.  Any applicable taxes on prizes are the sole responsibility of each winner. Limit: only one (1) prize will be awarded to any one participant and to any one cell/mobile number in any 30 days therefore the same person will not receive a prize even if using a different cell/mobile phone to participate within that 30 day period and a different person will not receive a prize within that 30 day period if such person wins using a cellular/mobile number that was used by a participant to win in the prior 30 days. Prizes are neither transferable nor redeemable for cash. Cosmic Infinity Inc. reserves the right to substitute a prize of equal or greater value if a prize is unavailable.  As this is a strictly skill based competition, your ability to win a prize is based upon the relative skill of the participants in the particular competition.

 By participating and accepting a prize, each winner acknowledges that his or her name, voice or city of residence may be publicized and the winner hereby consents and authorizes Cosmic Infinity Inc. to use such information without additional compensation.

 ELIGIBILITY:

Each competition is open only to legal residents of the US and Canada (excluding Quebec and excluding any provinces or states where restrictions in law apply to prohibit same) that were 13 years of age or older at the time of entry (note, participants who are under the age of majority may be required to present written acknowledgement and release of the parent/legal guardian to claim a prize). Employees of Cosmic Infinity Inc., and its affiliates and their immediate family members and persons living in the households of each are not eligible to participate. 

 GENERAL CONDITIONS:

Cosmic Infinity Inc. reserves the right to amend these rules without prior notice provided that any changes will be posted on the applicable menu on the cellular/mobile service provider’s wireless website and participants should ensure that they review such rules periodically for any such changes.

 In any dispute regarding a competition, the decision of Cosmic Infinity Inc. shall be final and binding.  By entering, participants agree to these rules and that the decision of Cosmic Infinity Inc. is final and binding in all matters relating to the competitions.

 Cosmic Infinity Inc. may suspend, withdraw or cancel a competition for any reason and at any time if, in its sole discretion, it determines that for any reason the competition is not capable of running as originally planned or if fraud or any other occurrence compromises the fairness or integrity of the competition.

 Any person considered by Cosmic Infinity Inc. to be cheating or manipulating the scoring in any way or engaging in a fraudulent or illegal activity in relation to a competition will be disqualified from the competition and from any other competitions offered by Cosmic Infinity Inc. 

 By competing and accepting a prize, participants release Cosmic Infinity Inc. and each of its affiliates, officers, directors, agents and employees from any and all liability, damages, or causes of action (however named or decided) with respect to or arising out of participation in the competition, or the receipt or use of the prize awarded.

 Cosmic Infinity Inc. and its affiliates, directors, officers, employees, agents and assigns are not responsible for technical, internet, hardware, software, or telecommunication malfunctions of any kind, lost or unavailable network connections, which may limit the ability to play or participate, or by any human error which may occur in the processing of any information associated with the competition. If for any reason (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Cosmic Infinity Inc., which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition), the competition is not capable of being conducted as described in these rules, Cosmic Infinity Inc. shall have the right, at its and their sole discretion, to cancel, terminate, modify or suspend the competition.

 Cosmic Infinity Inc. assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. Cosmic Infinity Inc. is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, cellular/mobile equipment, software, failure of any e-mail or entry to be received by Cosmic Infinity Inc. on account of technical problems, human error or traffic congestion on the Internet, any Web site, or any telecommunication service or any combination thereof, including any injury or damage to participant's or any other person's computer or cellular/mobile telephone or other wireless device relating to or resulting from participation in this competition or downloading or use of any materials in this competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COSMIC INFINITY INC. RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

 The laws of Ontario, Canada shall apply to each competition and these rules and regulations.
